More often than not, evidence of race discrimination in the workplace is well hidden.   While there is still the rare instance in which an employer, supervisor, or co-employee may openly use a racist term or scrawl a racist slogan somewhere, today race discrimination takes a more subtle form. 

Because discrimination today is so subtle, proving discrimination becomes more difficult.  The proof usually is not found by “looking for the bad guy.”  Rather, the proof lies in attacking the reasons an employer has given for its decision to layoff, not promote, or otherwise disadvantage a minority employee.  When the employer’s reasons don’t hold up to scrutiny, its real motives are exposed.

It is for these reasons that, without highly experienced attorneys skilled in uncovering the evidence of discrimination that lies beneath the surface, an employee bringing a claim of discrimination will likely not succeed.
